James Holmes entered a suburban Denver theater on July 20, 2012 with 400 people watched a midnight premier of the Batman movie “The Dark Knight Rises” and opened fire with a shotgun, an assault rifle and a semi-automatic handgun as more than 400 people.
Attorneys for James Holmes are expected to wrap up their case Friday, which means jurors could start deliberating next week on whether Holmes was legally sane when he murdered 12 people and injured 70. Defense lawyers called two psychiatrists, in which they evaluated Holmes and concluded he was incapable of telling right from wrong and was therefore legally insane.
Prosecutors argued the opposite and called two court-appointed psychiatrists who told jurors they evaluated Holmes as well and concluded that he could in fact distinguish right and wrong, even though he was mentally ill.
Once the case if officially wrapped up jurors will be taken to a conference room inside the Arapahoe County Courthouse and begin working their way through 166 counts against Holmes which are mostly murder and attempted murder charges.
Friday will include, one more witness from the defense, as well as video clips of Holmes from a jail surveillance camera, and then the conclusion of their case. Afterwards District Attorney George Brauchler will then make a rebuttal case which may take up to a day. Closing arguments have been arranged for Tuesday and deliberations could start as early as Wednesday.
On Thursday after the jury had been sent home for the day, Judge Samour told Holmes the Constitution gives him the right to decide whether or not to take the stand and then asked what he wanted to do.
His response “I choose not to testify.”
