Thursday the Supreme Court ruled that Texas has permission to reject a Confederate battle flag design for license plates.  A license plate design was submitted by a group called the Sons of Confederate Veterans (SCV) and featured Confederate battle flag which has been considered very controversial.

The group designed the license plate to honor the reputation of soldiers who fought for the Confederacy during the Civil War.  The SCV argued that when the state rejected the design, it had violated their rights to freedom of speech.

However in a 5-4 decision led by Justice Stephen Breyer, the Court held that the designs for the license plate are a part of government speech instead of private speech.  Unlike private speech, the government is allowed to discriminate based upon content when it speaks.

Breyer said that “just as Texas cannot require SCV to convey the State’s ideological message, SCV cannot force Texas to include a Confederate battle flag on its specialty license plates.”
