According to Fox news no criminal charges will be filed against the care worker who refused to perform CPR on 87 year old Lorainne Bayless.

The Bakersfield Police Department in California has closed its investigation and the nurse has taken a voluntary leave of absence.

The nurse’s supervisor and the owner claimed the employee acted appropriately and according to the guideliness of the Tennessee-based California Inc. Brookdale Senior Living Inc. but has since reversed itself and said the unidentified employee had misinterpreted the company’s guidelines.

The family of Mrs. Bayless are satisfied with the outcome saying Mrs. Bayless was aware of the policy and that is was her desire to forgo resuscitation efforts if anything like this happened and that she died of natural causes.  The family said it has no intentions of suing the company or seeking punishment for its workers.
