A 34-year veteran Baltimore police officer was charged with assault for spitting on a man during an arrest, WBALTV reports.

The incident involving Alfred Evans, 31, and Sgt. Robert Messner occurred on Oct. 12th, when Messner ordered people to move from the steps of a local neighborhood building. It is unclear if the group contained residents of the surrounding area or not.

Evans was then taken into police custody as bystanders filmed the encounter.

In the video above, a handcuffed Evans can be seen on the ground with Messner above him. The footage shows the officer spitting on the Parkville resident while the crowd around them reacts. An investigation was launched after the video gained traction on the internet.

On Tuesday, the Baltimore City State’s Office announced the officer was officially charged with second-degree assault and misconduct.

WBALTV reports:

“Today Officer Robert D. Messner was charged with second-degree assault and misconduct in office for allegedly spitting on Mr. Alfred Evans while he was in police custody on October 12, 2015,” the brief statement says. Mayor Stephanie Rawlings-Blake and the police commissioner condemned the officer’s alleged misbehavior.

Rawlings-Blake reportedly urged the officer to resign in the wake of tension between cops and people of color.

The misdemeanor holds a conviction of up to ten years in jail and a $2,500 fine. Messner is scheduled to be arraigned Nov. 19.
